Consumer Affairs Victoria's guidelines say the rental provider is responsible for keeping the property in good repair, while the renter must keep it reasonably clean and free from damage. At the end of a lease, the renter has to leave the place in the same condition they found it, taking fair wear and tear into account.
Fair wear and tear is deterioration from everyday use or natural forces such as sunlight, and it isn't damage. The guideline notes VCAT has reduced or disallowed landlord claims for minor marks on walls where only a limited part could be put down to the renter. The condition report from the start of the lease is what settles most of these questions.
